Terms of Service

01Acceptance & who we are

These Terms of Service ("Terms") are an agreement between you and Gigahertz Company LLC ("Gigahertz", "we", "us"). They apply when you create a Lookshelf Cloud account or use the hosted Lookshelf Cloud service. By creating an account or using the service, you accept these Terms. If you do not agree, do not use Lookshelf Cloud.

02The service

There are two distinct things, and it matters which one you are using:

• The Lookshelf desktop app is free and open source. It is a local artifact browser for your Markdown documents, HTML artifacts, JSX components, images, and PDFs. It works fully offline, requires no account, and sends us nothing. Its source code lives at github.com/gigahertzllc/lookshelf.
• Lookshelf Cloud is our optional, paid, hosted backup service. It provides managed encrypted backup of your library. Free accounts get 100 MB of backup storage. Lookshelf Pro ($4/month) gets 10 GB, version history (the last 10 versions of each file), 30-day trash restore, and multi-device restore.

You never need Lookshelf Cloud to use the app. Anyone can also self-host the backup backend from the repository with their own keys; the hosted service is the convenience option.

03Accounts

To use Lookshelf Cloud you need an account. You agree to:

• Provide an accurate email address you control. We use it for login, receipts, and service notices.
• Keep your password and access tokens safe. Activity under your account is your responsibility until you tell us it has been compromised.
• Be at least 13 years old. Lookshelf Cloud is not directed at children under 13.

04Subscriptions & billing

Lookshelf Pro costs $4 per month, billed through Stripe Checkout. Card numbers never touch our servers; Stripe processes all payments.

• Auto-renewal. Your subscription renews automatically each month until you cancel.
• Cancellation. You can cancel any time. Cancellation takes effect at the end of the current billing period, and you keep Pro features until then.
• No partial refunds. We do not issue refunds for partial months.
• Price changes. If we change the price, we will give you at least 30 days notice by email before the new price applies to you.

05Your content

You own your content. Nothing in these Terms transfers ownership of anything you store in Lookshelf Cloud to us.

You grant Gigahertz only the limited license needed to operate the service: to store, encrypt, mirror for backup, and serve your content back to you and your devices. We claim no other rights to it.

You are responsible for what you store. You agree not to use Lookshelf Cloud to store or distribute content that is illegal, that infringes someone else's intellectual property, or that contains malware. We may suspend or remove content that violates this section.

06Storage limits & fair use

Storage quotas apply per plan: 100 MB for free accounts and 10 GB for Lookshelf Pro. Writes beyond your quota may be rejected.

To keep the service healthy for everyone, we apply per-account limits, including download budgets that also protect you against a stolen access token. We may throttle accounts whose usage patterns degrade the service or fall well outside personal-library use. Lookshelf Cloud is a personal backup service, not a content-distribution network.

07Data durability

We take durability seriously. Lookshelf Cloud keeps the last 10 versions of each file for Pro accounts, keeps deleted files restorable for 30 days, and mirrors every write to a second backup store that deletions never touch.

These are commercially reasonable efforts, not a guarantee. No backup service can promise your data will never be lost. Keep local copies of anything critical — the desktop app is local-first by design, so this is the normal way to use Lookshelf anyway.

08Open-source license note

The Lookshelf application code is licensed under the license published in its repository at github.com/gigahertzllc/lookshelf. That license — not these Terms — governs your use of the code, including building the app for other platforms or self-hosting the backend.

These Terms govern only the hosted Lookshelf Cloud service.

09Termination

• By you. You may close your account at any time.
• By us. We may suspend or terminate your account for breach of these Terms or for nonpayment. Except where the breach requires immediate action, we will give you notice by email first.
• Data export. After termination, we will make your data available for export for a reasonable window (at least 30 days, except where we are legally required to remove content) before it is deleted.

10Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GIGAHERTZ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST.

11Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGAHERTZ'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. GIGAHERTZ IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email or in the app at least 30 days before they take effect. Continuing to use Lookshelf Cloud after a change takes effect means you accept the updated Terms. If you do not agree, cancel and export your data before the effective date.

13Governing law

These Terms are governed by the laws of [STATE — TO BE CONFIRMED BY COUNSEL], without regard to conflict-of-law rules. Any disputes will be resolved in the courts of [VENUE — TO BE CONFIRMED BY COUNSEL].
